Intellectual Property Services
You’ve decided on a brand, and it’s ready to explode in popularity; but, you’re not sure if it’s still available, and you’re not sure what other brands are available that are comparable to yours. It’s possible that you’ve been putting money into your brand for a number of years, and now you want to safeguard the valuable reputation it’s earned. Or, it may be too late to prevent someone from stealing your idea or logo, which could lead to consumers confusing their products with your own.
You might be interested in selling or licensing your brand, or perhaps you are considering taking things to the next level by bringing it into another country. When you register a trademark, you safeguard the identity of your company and prohibit others from using a mark that is confusingly similar to or identical to yours. This applies to any of the instances listed above. Your trademark has the potential to become the single most valuable asset in your company if it is adequately secured. In order to successfully register your trademark, you will need to overcome a few obstacles and employ some strategies.

LICENSING AND REGISTRATION OF MARKS.
We will manage the entirety of the registration process and see to it that your brand is legally protected and that you retain ownership of it. These are the following:
Step 1: Filing your mark.
- When a trademark is filed, which is the first step in the application procedure that is involved in registering your trade mark, the trademark is protected from the very first minute that it is filed (if it progresses to registration).
- What we shall do is:
- Create a filing plan with the goal of increasing the chances of successfully registering your business.
- Determine which categories of items or services are relevant to your investigation.
- Establish the criteria for the products or services that will be included in the relevant classes.
- The Company and Intellectual Property Commission (CIPC) is where you should file your petitions.
Step 2: Analyze the performance of your team.
- After a period of approximately a year, the CIPC will review the application and decide whether or not to accept it, provisionally refuse it, or accept it subject to conditions.
- What we shall do is:
- Inform you of the examiner’s reaction and work together with you to formulate a plan to either satisfy the examiner’s conditions or get around the provisional refusal.
- Either provide the examiner with evidence that satisfies their requirements, or take the necessary measures to overturn the provisional denial.
Step 3: Publicizing Your Event and Getting Registered
After it has been reviewed and approved, we will submit your application for publication in the South African Patent Journal so that others may file an opposition.
What we shall do is:
- Offer a plan of action and help with either negotiation or litigation in the event that an objection is raised.
- You should write out your registration certificate and finish the procedure if there are no objections or if an objection has been overcome, whichever comes first.
